Terms and Conditions
The
following terms and conditions form the basis of the contract between
the Leisure Breaks Company Ltd and the tour operator or group organiser.
Confirmations
- After we have received a signed copy of the quotation,
we will issue a confirmation within 10 working days.
- All bookings are
held for 14 days from the date of contract confirmation, by which
time acknowledgment is required in writing, by signing and returning
a copy of the confirmation.
- In the absence of a signed copy, the Leisure
Breaks Company Ltd reserves the right to re-sell any unconfirmed
rooms, theatre or event tickets held on your behalf.
Currency
In the unlikely event of a major devaluation of sterling against
foreign currency we reserve the right to implement a surcharge.
Prices
- All prices are based on a minimum of 30 paying passengers;
we reserve the right to increase the prices should we be asked to operate
a tour with fewer.
- All brochure and any other quoted prices are net
and non-commissionable.
Accommodation
- We base our accommodation rates on two people sharing
a twin or double room; rooms for single occupancy may attract a supplement.
- We reserve the right to offer alternative accommodation of a similar
if not higher standard, in the event of an over booking situation
by either the Leisure Breaks Company Ltd or any named hotel. We will
cover any additional cost.
- The Leisure Breaks Company Ltd cannot be
held responsible for any items of expenditure which do not form part
of any inclusive break.
- We cannot be held responsible for any changes
that may be due to civil unrest or industrial disputes.
- Hotel ratings
are shown within the body of our brochure. The absence of a star
rating or equivalent does not necessarily mean a lower standard of
hotel, but merely indicates the respective hotel may be waiting for
inspection or has chosen not to recognise the local rating organization.
- Some hotels reserve the right to serve breakfast in the hotel room;
we will make every effort to ensure that breakfast is served in the
hotel restaurant.
- We reserve the right to refuse any group at any
time.
- The clients render themselves liable for any monies owing for
damages caused by any member(s) of the group.
Theatre / Event tickets
- All theatre tickets are sold subject to availability
at the time of booking. We cannot be held responsible for tickets that
are not available after the deposit / confirmation date is due.
- We
cannot be held responsible for any performance cancelled or any performance
where “named” individuals do not appear.
- All deposits are
non-refundable without prior agreement.
Crossings
- You are required to travel on your booked crossing and in
the event of your delay and extra cost becoming payable you are responsible.
- Refunds due to failure to cross, for whatever reason, are strictly
limited to what we can, if any, recover from third parties. We would
strongly advise you and your passengers to have adequate insurance
to cover such eventualities.
- You are required to comply with your
crossing operators standard terms and conditions of carriage – copies
available from our office.
Brochure
Accuracy
Every effort has been made to describe hotels and resorts as
accurately as possible. However, as this brochure is printed many months
in advance, some of the facilities may be altered or temporarily withdrawn
due to a lack of demand, reparation work or maintenance etc. Whenever
we are told of any significant change we will advise you. We reserve
the right to make any changes to any description or price contained
in our brochure at any time after publication.
Cancellation by you
With the exception of theatre / concert or event
tickets which are non-fundable, cancellations by you will only be accepted
without charge up to 43 days prior to the date of arrival, unless otherwise
specified in our quotation. We reserve the right to charge you for
any costs we may incur following the late cancellation of your tour based
on the following:
28-42 days prior to arrival 30% charges may apply
14-27 days prior to arrival 45% charges may apply
7-13 days prior to arrival 60% charges may apply
0-6 days prior to arrival 100% charges may apply
Cancellation by us
If we cancel a tour at any time, due to circumstances
beyond our control, including industrial action and bad weather, the
Leisure Breaks Company Ltd will have no liability whatsoever. We will
of course try to offer an alternative tour of a similar standard or
refund you any monies already paid.
Payment
- All deposits and final balances are due by the date specified
on our confirmation, we reserve the right to cancel any part of the
tour held on your behalf and charge any additional expenses if these
dates are not met.
- We reserve the right to withhold the necessary travel
vouchers where payment has not been received by the notified and
due date.
- Where credit terms are available, invoices are to be paid
in full by the agreed date, otherwise we reserve the right to charge
interest at the current Bank of England rate plus 2%
- All rates are
quoted per person inclusive of any service charge or booking fee
and are VAT inclusive at the current rate. We reserve the right to
review any rates quoted at any time.
Passengers
- Passports and any necessary visas are the responsibility of your
clients.
- We strongly advise that all your passengers and crew are fully
insured for overseas visits.
- It is your responsibility to comply with
Package Tour Regulation 20, 1992 and protect your clients money and
have a repatriation scheme in place
- We must be informed of any special
category groups at the latest with your signed confirmation. This
includes youth groups, sports clubs (team, social or spectator groups),
and disabled or predominantly single gender groups. We will check with
our suppliers (hotel and crossing company) to ensure that they accept
such groups and only when we issue a group confirmation can you assume
that we are able to accommodate your request. Failure to notify us
of such a group could result in your group being refused carriage
or hotel admittance for which the LBC ltd will accept no responsibility
Legislation & Protection
The statutory package travel, package holidays and package tours regulations,
where applicable are your responsibility and you must ensure compliance
with the relevant legislation. Your money and your clients money is
secure; Leisure Breaks Company Ltd operates within the terms of the European
Community by providing passenger protection if required and where necessary.
Complaints
In the event of any problem or complaint that cannot be resolved
at the time, you must notify us in writing with all the relevant details
within 14 days. We will do all we can to ensure that your complaint
is dealt with promptly and settled to the mutual satisfaction of all
concerned.
Special Requests
We will do our utmost to ensure that any special requests
are met; however we cannot guarantee that they will be. Should any
special request not be fulfilled it will not constitute a breach of contract.
Financial Failure
In accordance with the package travel, tours regulation
1992 all passengers booking with the Leisure Breaks Company Ltd is
fully insured for the initial deposit and subsequently the balance of
all monies paid to us including repatriation if required, arising from,
the cancellation or curtailment of your travel arrangements due to insolvency
of the Leisure Breaks Company Ltd.
This insurance has been arranged by Towergate Chapman Stevens through
igi Insurance Company Ltd.
A copy of these terms and conditions is also
shown on the reverse side of our booking confirmation.
Any contract
is made on the terms of these booking conditions, which are governed
by English law, and both parties shall submit it to the jurisdiction
of the English Courts.
